Kris Humphries says no divorce to Kim Kardashian.

Instead, he is seeking for an annulment.

He filed his papers today, on the grounds of ‘fraud.’

People magazine reports that his Superior Court Filing papers has the box reading ‘nullity of voidable marriage,’ and checks the basis the box saying ‘fraud.’

In California Law it is hard to get an annulment unless he can prove that the marriage was really a fraud.

Kris also added that if annulment is not granted, he will file for legal separation.

According to TMZ, it is impossible that Kim will agree on annulment, because she told everyone that she really loved Kris and it just did not work out for both of them.

In this case, LA family lawyer Scott Weston , gave his opinion that Kim will probably fight the matter unless she’s willing to agree that ‘she defrauded him.’

In short, it can be a battle for both of them in court.

They got married on August and immediately started taping the second season of Kourtney and Kim Take New York.

On the first episode of the show, Kim and Kris constantly fight.

A source close to Kris said, “Kris is sensitive to marriage both emotionally and religiously.”

“He went into it in good faith and never expected things to turn out this way.”

The reality star filed for divorce in October 31 which Kris said he was blindsided by her decision.

The 31-year-old star said on an interview with US Glamour magazine, she said she will always be a hopeless romantic.

“I believe and  love and the dream of having a perfect relationship, but my idea of it has changed.”

“I think I need to not live in a fairytale like that. I think I maybe need to just snap out of it and be a little bit more realistic. What I want is not possible.”
